Interpretation
1.1 References to any statutory provision, authority, rule or code of practice shall be deemed to include the amended versions, replacements or successors of such.
The Quotation
2.1. Bets Spray Renders Ltd shall provide to the Client a proposal for the services to be provided (“The Quotation”), which shall set out the following:
a) The services in which Bets Spray Renders Ltd will undertake.
b) The date or time period within which the service will be performed.
c) The price which the Client shall be charged for the performance of the services, including:
i) Any fee which Bets Spray Renders Ltd will charge.
ii) Any disbursements or expenses which Bets Spray renders Ltd will require the Client to meet iii) Any VAT or tax element which will be payable to the Client.
2.2 Client must choose colour 14 working days before the arranged start date of the project. The start date may be delayed, if not selected.
2.3 Bets Spray Renders require a scaffold with the following requirements in which adhere to UK safety standards:
a) Scaffold must be 200mm away from the areas that are to be rendered.
b) Lift heights must be no more than 2400mm with ladder access to all levels.
All scaffolding services can be arranged Via Bets Spray Renders Ltd unless the Client prefers otherwise.
2.4 The Quotation shall be attached to these terms and conditions as a schedule and where two parties enter a contract between Bets Spray Renders and the Client. The Client would be deemed to have accepted the content of the Quotation in full.
Payments
3.1. The contract price is set out in the Quotation. This includes the details of the charges Bets Spray Renders will make for all following aspects of the job; labour, materials, and any taxes/additional costs or expense or disbursements, which Bets Spray Renders Ltd may charge to the Client.
3.2 Clients with projects quoted either £3,000 or less must agree to the following:
a) Client must pay 50% of the quoted price of the project three days before commencement of works. Without this payment, the project can not start.
b) A further 50% upon completion.
3.3 Clients with projects quoted £3001.00 and above must agree to the following:
a) Client must pay 30% of the quoted price of project three days before commencement of works, without this payment project, can not start.
b) Client must pay 30% of the quoted price of the project at the agreed date, typically half the way through the project.
C) Client must pay the remaining 40% of the project’s price after completing the works. The Client must pay the balance within 14 days of completing the work.
3.4 Works can be considered and signed off as completed once the works quoted have been completed.
3.5 Notwithstanding 3.2 and 3.3 above, Bets Spray Renders may vary the contract price from the amount set out in the Quotation where he has provided services with are different or in addition to those set out in the Quotation either at the specific request of the Client or because he has been required to complete additional work which was not anticipated at the time of the Quotation was made, or because of market fluctuations in the price of materials. Any extra works required by the Client will be charged at £200.00 per day, per man, plus the cost of any additional material charges incurred.
3.6 The Client Agrees:
a) Not to withhold any sums due to Bets Spray Renders Ltd.
b) To settle all invoices raised by Bets Spray Renders Ltd within the specified time stated on the invoice.
c) To pay Bets Spray Renders Ltd interest at a rate of 5 percentage points per annum a the Bank of England base rate on any payments in accordance with Sections 3.2 and 3.3.
d) To pay Bets Spray Renders Ltd such costs and expenses as he may incur in recovering payment from the Client where the Client fails to make payment in accordance with these terms and conditions.
Client Obligations
4.1 The client should co-operate with Bets Spray Renders Ltd as this may be necessary to facilitate this agreement, including but not limited to:
a) Permitting Bets Spray Renders Ltd access to the property/location (“The Site”) in which the services are being supplied too—assuring that such access is appropriate and adequate.
b) Providing for Bets Spray Renders necessary facilitates to complete the services.
